Yuma Book

Terms of use

These terms govern Yuma Book at https://yumabooking.com, operated by Yuma IT Pty Ltd (ABN 62 684 389 839) of 49 Phillip Ave, Watson ACT 2602, Australia. They apply unless a signed agreement with us says otherwise. By creating an account, listing a business, sending a quote, making a booking, or otherwise using the service, you agree to these terms, the Refund and cancellation policy, and the Privacy policy. If you use the service for an organisation, you confirm you have authority to bind it.

1. Product scope

Yuma Book is a marketplace that helps event organisers find mobile food and beverage vendors, mainly in Canberra, the ACT and surrounding NSW. We provide software: listings, messaging, quotes, bookings, invoices, compliance storage and related tools.

We do not employ, subcontract or insure vendors. We do not supply the food, drink or on-site event services. A listing, badge or reviewed document is not a recommendation, accreditation, licence check that remains valid on the event day, or government endorsement. We do not give legal advice.

2. Your responsibilities

You may request account deletion in workspace settings. Deletion is delayed 30 days, blocked while you are the sole owner, and blocked while the organisation has open bookings or retained payment and invoice records. See the Privacy policy.

3. Our responsibilities

Distances, maps, ABN lookups and locality centres are approximate. We may suspend, edit or remove listings, accounts or content that breach these terms, appear unlawful, or risk other users.

4. Quotes and bookings

A quote, acceptance, deposit request or booking on Yuma Book creates a contract between the organiser and the vendor, not with Yuma IT Pty Ltd, except for our platform fee and these terms. Messages and amendments on the platform form part of that contract where the parties agree.

5. Non-attendance and service quality

Yuma IT Pty Ltd is not responsible if a vendor does not attend, is late, sends the wrong vehicle or staff, runs out of food, fails a health inspection, causes property damage, or otherwise fails to perform. We are not responsible if an organiser cancels, refuses site access, understates attendance, or fails to pay. Claims about performance, quality, allergens, injury or loss from the event services are between the organiser and the vendor (and their insurers), except to the extent Australian Consumer Law or other law makes us liable and that liability cannot be excluded.

We may, at our discretion, help the parties communicate, record a dispute, suspend a listing, or keep an audit trail. That help is not an admission of liability and is not a promise to compensate either party.

6. Payments and fees

Card and live payments on Yuma Book may be disabled. Where they are disabled, money that changes hands outside the platform is solely between organiser and vendor. Test or local payment records are not evidence that money was received.

When live payments are enabled, organisers pay through our payment partner. The vendor price plus our platform fee (currently 5% of the vendor total, or the fee shown on the booking) is the amount charged unless a quote says otherwise. We are not a bank, escrow agent or insurer. Payment partners have their own terms.

7. Refunds and cancellations

The full policy is the Refund and cancellation policy. In short: organiser cancellations follow the vendor’s booking policy; vendor no-shows are a claim against the vendor, not against us; we only refund money we collected; platform fees are generally kept except where law requires otherwise.

8. Acceptable use

You must not:

We may suspend access to protect customers, the service, or our legal obligations.

9. Intellectual property

Yuma Book branding, software and documentation belong to Yuma IT Pty Ltd or its licensors. You retain ownership of content you upload and grant us a licence to host and display it as needed to operate the service, including public profiles you publish. Location data attribution is on Location data.

10. Disclaimers, liability and indemnity

The service is provided as-is. To the maximum extent permitted by law we exclude all implied warranties about availability, accuracy, fitness for a particular event, or uninterrupted access.

Australian Consumer Law. If you are a consumer, you have guarantees that cannot be excluded. For major failures you may cancel and receive a refund for our unused platform service, or compensation for its reduced value. For minor failures we may repair or replace our service. Those guarantees do not make us the supplier of the vendor’s food, drink or on-site performance.

To the maximum extent permitted by law, Yuma IT Pty Ltd is not liable for lost profits, wasted event costs, reputational harm, data loss, or indirect or consequential loss, or for vendor or organiser acts or omissions (including no-shows). Where our liability cannot be excluded, it is limited to resupplying the platform services or paying the cost of resupplying them, and in any case will not exceed the platform fees you paid us in the 12 months before the claim.

You indemnify Yuma IT Pty Ltd against claims, losses and costs arising from your content, your event, your breach of these terms, or your supply of food, drink or venue access, except to the extent caused by our fraud or wilful misconduct.

11. Suspension and termination

We may suspend or close an account or listing with or without notice where we reasonably believe these terms, a law, or another user’s safety is at risk. You may stop using the service at any time. Bookings already formed, fees, privacy, liability and indemnity survive termination.

12. Governing law and contact

These terms are governed by the laws of the Australian Capital Territory. The courts of the ACT have exclusive jurisdiction, subject to any rights you have to use another Australian forum that cannot be excluded.
